Terms of use

contract of a public offer for the sale of tickets for shows, performances, concerts
or sports programs, as well as other entertainment events.

The present contract of the offer is made in accordance with the "Rules for the sale of goods by remote means" approved by the Resolution of the Government of the Russian Federation of September 27, 2007 No. 612 and the Law "On Protection of Consumer Rights" of February 7, 1992 No. 2300-I with the latest amendments and additions.

Preamble

In this offer, if the context does not require otherwise, the following terms have the following meanings:

"Offer" means the public offer of the Contractor addressed to any individual (citizen), to conclude a service agreement with him (hereinafter referred to as the "Contract") on the existing terms and conditions contained in the Agreement, including all its annexes.

"Internet site", "Internet site of the Contractor" - a set of electronic documents (files) of the Contractor in a computer network, united under the address (domain name) www.bigbilet.ru

"Contractor" - LLC "ON-LINE DATA CENTER", rendering services to the Consumer for the purchase of Tickets, presented on the Contractor's website, as well as on the websites of the entertainment institutions listed on the Contractor's website and the corresponding Addition # 1 "Rules for the circulation of" electronic tickets ".

"Consumer" means an individual who has concluded a contract with the Contractor on terms and conditions contained in the Agreement and its Annexes.

"Acceptance" means full and unconditional acceptance by the Consumer of the terms of the Agreement and of the Appendices thereto.

"Ticket" is a paper ticket for performances, performances, concert or sports programs, as well as other entertainment events presented on the Contractor's website, as well as on the websites of the entertainment institutions listed on the Contractor's website and the corresponding Addition # 1 "Rules for the circulation of "electronic tickets" .

Service "is a set of interrelated and mutually complementary legal actions performed by the Contractor in favor of the Consumer, including the provision of information on the event and the attributes of Tickets available for purchase on-line; Purchase by the Contractor of Tickets in favor of the Consumer from the organizer of the event; Informational support of the Consumer up to the moment of visiting the event; The provision of Tickets in accordance with Appendix No. 1 "Rules for the circulation of" electronic tickets "; In case the organizer violates the essential conditions of the event, namely the cancellation of the change of the action, demanding the full amount in favor of the Consumer and ensuring the return of this amount to the Consumer.

"Order" is the independent registration by the Customer of the Contractor's services on the Internet site, including the selection of Tickets.

General

This Agreement and its annexes are official documents of the Contractor and an integral part of the Offer. The current version of the document is available on the Contractor's website www.bigbilet.ru/offer.html, as well as at the Contractor's office. LLC "ON-LINE DATE CENTER", hereinafter "the Executor" publishes an offer for rendering services for individuals to purchase Tickets for performances, performances, concert or sports programs, as well as other entertainment events on the Contractor's website, as well as on Sites of entertainment institutions listed on the Contractor's website and the corresponding Addition No. 1 "Rules for the circulation of" electronic tickets ".

In accordance with Article 437 of the Civil Code of the Russian Federation (Civil Code), this document is a public offer, and in the event that the conditions set forth below are met, an individual (hereinafter referred to as the Consumer) who accepts this offer shall execute the Order and receive Tickets in accordance with the terms of this Contracts and Addition 1 "Rules for the circulation of" electronic tickets ".

In accordance with clause 3 of Article 438 of the Civil Code of the Russian Federation, payment of the Order by the Consumer is an acceptance of the offer, which is considered equivalent to the conclusion of the Agreement on the conditions set forth in the offer.

On the basis of the foregoing, carefully read the text of the public offer, and if you do not agree with any point of the offer, you are invited to refuse to purchase and / or use the services provided by the Contractor.

Subject of the contract

The Contractor renders services to the Consumer in accordance with the current prices published on the Contractor's website and the sites of the entertainment institutions listed on the Contractor's website, and the Consumer forms the Order, makes payment for it and receives Tickets in accordance with the terms of this Agreement and Appendix # 1 "Rules for the circulation of" electronic tickets ".

A customer who intends to use the services of the Contractor confirms its consent to the terms of this offer by registering on the RU-NIC's website or on the website of the entertainment institution listed on the Contractor's Internet site, specifying a personal mobile phone number for sending SMS.

To complete the registration, the Executor sends an individual access code (PASSWORD) to the Consumer for the execution of operations for the execution of the Order.

When registering on the Performers website, the Consumer undertakes to provide the following registration information:

  • personal mobile phone number
  • E-mail address
  • surname, first name, middle name (optional)

When registering, the Consumer has the opportunity to specify fictitious data and thus maintain his anonymity, but is responsible for the complete or partial impossibility of executing the Order by the Contractor, due to incorrect indication of information provided during registration.

The Contractor does not change or edit the registration information about the Consumer.

The Contractor undertakes not to disclose registration data, as well as other information relating to the Order, to persons not related to the execution of the Order.

A consumer who intends to refuse SMS information messages of the Contractor, dedicated to announcements of upcoming events or event organizers, confirms his desire by calling from his personal mobile phone to telephone number 88005559554. The executor records such a call from the Consumer, automatically determines the number from which the call was made, And sends a confirmation SMS in response.

Ordering

Selection of available Tickets, execution of the Order and subsequent payment are made by the Customer independently, taking into account the provided opportunities of the Contractor's Internet site.

The Order is formed by the Customer independently by selecting the items of interest and available through the Contractor's Internet site. The number of tickets chosen by the Consumer should not exceed 5 (five) pieces in one Order.

Payment Order

Payment for the Order is carried out by the Customer independently by any of the offered non-cash ways of transferring funds (payment systems) indicated on the Performers website:

  • using the cards of international payment systems VISA or MasterCard
  • using the electronic payment systems
  • using the payment terminals

Full or partial payment of the Order in cash in the Contractor's office is not provided.

The order of payment, including control, confirmation of payment and completion of the procedure for payment of the Order is carried out on the basis of the rules and conditions of the payment system chosen by the Consumer as a method of payment.

Payment by the Customer of a self-placed Order on the Contractor's website means the consent of the Consumer to the terms of this Agreement and its annexes. The date and time of payment of the Order is the date and time of conclusion of the Offer Contract between the Contractor and the Consumer.

The Contractor shall not be liable for the incorrect operation of payment systems, errors, failures, refusal to authorize payment and any other circumstances of the inability or partial operability of payment systems that do not allow the Customer to pay for the Order.

Successful completion of payment for the Order is confirmed by the Contractor by sending an SMS message with the PIN of the "Electronic ticket" to the mobile phone number specified by the Consumer at registration.

Delivery Order

When executing the Order, the Contractor immediately delivers an "electronic ticket" to the Consumer without charging additional money.

Delivery to the Consumer is made by the Contractor by sending:

  • SMS-messages with the PIN-code of the "Electronic ticket" to the number of the personal mobile phone of the Consumer specified during registration;
  • Electronic message (e-mail) indicating the attributes of Tickets specified by the Customer in the Order.

Delivery time

The Contractor executes the Order immediately upon receiving a positive response from the payment system about the successful completion of payment under the Order.

In accordance with this agreement, the Order is considered to be executed, and the services rendered when the Executor sends an SMS message with the PIN code of the purchased "Electronic ticket" to the number of the personal mobile phone of the Consumer specified at registration.

If the Consumer provides inaccurate information during registration, communication errors in data transmission networks, errors caused by incorrect operation of the consumer's mobile communication device, the Contractor shall not be liable for improper execution of the Order.

Returns & Exchanges

In accordance with the entry into force on September 1, 2019 of the Federal Law of July 18, 2019 N 193-FZ "On Amending the Law of the Russian Federation" Fundamentals of the Legislation of the Russian Federation on Culture", according to which the procedure for returning electronic tickets is regulated, namely:

If a visitor refuses to attend a spectacular event organized by an organization of performing arts or a museum for reasons not provided for in part ten of this article, the visitor has the right, upon returning a ticket, subscription or sightseeing ticket:

  • not later than ten days before the day of the entertainment event to receive back 100 percent of the price of a ticket, subscription or sightseeing tour;
  • less than ten days, but no later than five days before the day of the entertainment, to receive at least 50 percent of the price of the ticket, subscription or excursion ticket;
  • less than five days, but no later than three days before the day of the spectacular event, get back at least 30 percent of the price of a ticket, subscription or sightseeing ticket.

In case of cancellation, replacement or transfer of a performance organized by an organization of performing arts or a museum, a visitor, on his initiative, is reimbursed for the full cost of the ticket in accordance with the procedure established by the performing arts or museum.

The rights, duties and responsibilities

The Executor is not liable for improper performance of the duties of the organizer of the event, whose Tickets are on the Internet site of the Performer and the sites of the entertainment institutions listed on the Contractor's website.

The Contractor has the right to transfer its rights and obligations for execution of Orders to third parties.

In accordance with art.436 of the Civil Code of the Russian Federation, this offer is not irrevocable. The Contractor has the right to refuse to place the Order to persons expressing disagreement with the terms of this Agreement.

The consumer undertakes not to use "Electronic tickets" for business purposes.

The ownership of Tickets, as well as the risk of their accidental loss, shall be transferred to the Consumer from the moment the Order is executed by the Contractor.

All claims for improper execution of the Order The consumer has the right to send to the e-mail address . All incoming information is processed as soon as possible.

The consumer undertakes to protect the Executor from claims, claims and other complaints from the event organizer that arose upon the return of the Tickets on the Consumer's initiative, and also assumes unconditional responsibility for the costs and damage of the Contractor arising from such claims.

The Contractor reserves the right to refuse service to the Consumer without explaining the reasons.

Personal Data

When registering, the Consumer has the ability to specify fictitious data and thus maintain his anonymity.

The information received from the Customer at registration is used by the Executor exclusively for the purposes of servicing the Consumer, including but not limited to polling the visitors to the Internet site about the quality of the Contractor's services, sending information or advertising messages.

In the course of order maintenance, the Customer's personal data in automatic mode is transferred by the Contractor to payment systems in order to ensure the possibility of receipt of payments from the Consumer and subsequent control over the payment; Communication companies that provide data transmission via GSM communication channels in order to send SMS messages to the Consumer; The official partners of the Contractor in the event that the Consumer has expressed a desire to participate in promotions or to receive a gift when placing an order; To the direct organizer of the event, in order to ensure that the delivery and receipt of paper tickets by the Consumer is recorded.

The Contractor provides an opportunity for the Customer to cancel his registration, to prohibit the sending of information messages, to exclude his participation in promotions and joint programs with the official partners of the Contractor when completing his order.

"Electronic ticket" is a digital entry in the database of the Contractor's Internet site, and contains information identical to the information of the Ticket attributes authorized for distribution and sale by a certain entertainment institution.

"Electronic ticket" certifies the right of the Consumer to the Ticket to visit a certain entertainment event of a certain entertainment institution in a certain place at a certain time.

In addition to the mandatory attributes of a paper Ticket, the "Electronic Ticket" has a personal identification number (PIN).

The PIN code is used to perform the operation of exchanging the "Electronic ticket" for a material carrier (paper Ticket), and is an analogue of the Consumer's signature in accordance with Cl. 847 of the Civil Code of the Russian Federation when performing an operation to receive a paper Ticket.

The PIN code is sent to the Consumer by SMS message to the number of the personal mobile phone specified at registration, and the Consumer is personally responsible for the safety of the received message. It is not possible to recover or receive a copy of the PIN. The loss of the PIN code is equivalent to the loss of the material carrier (paper Ticket).

The PIN code is strictly confidential, and the Consumer assumes unconditional obligations of keeping the PIN-code secret from third parties, excluding the recording or duplication of the PIN-code on any media, and also transferring the PIN-code to third parties.

For the exchange of the "Electronic ticket" to the material carrier (paper ticket), the Consumer confirms the legitimacy of this operation by introducing a PIN on the terminal (ticket terminal) installed in the entertainment institution.

When the Consumer presents the correct PIN-code on the terminal, the Paper Ticket is printed and the User is allowed to attend the event.

The presentation of other reasons for the identification of the Consumer and the exchange of the "Electronic Ticket" on the material carrier (paper ticket) is not provided.

Letter-messages accompanying the sending of the "Electronic Ticket" to the Consumer are not forms of strict accountability or documents on the basis of which the "Electronic Ticket" is exchanged. The exchange of the "Electronic ticket" for the material carrier (paper ticket) is made no earlier than 30 minutes before the start of the event and can not be disputed by the Consumer.
